Accident Reports

Who is at fault? All accidents in New Jersey are documented by the police with a uniform New Jersey Police Crash Investigation Report (Form Number NJTR-1). The Accident Report contains two digit numeric codes identifying the "Apparent Contributing Circumstances" and other importent information about the the accident. What is the "Verbal Threshold" under New Jersey law?

In 1998, the New Jersey state legislature (in an attempt to make New Jersey auto insurance more affordable) created the Verbal threshold/Limitation on Lawsuits. It is a restriction on the right to sue for pain and suffering. Unless you elect to pay extra on your insurance (and most people do not), you will be barred from suing for pain and suffering unless your injury involves:
    1. Death (fatal accidents)
    2. Dismemberment
    3. Significant Disfigurement or Scarring
    4. Displaced Fractures
    5. Loss of a Fetus, or
    6. A permanent injury within a reasonable degree of medical probability
